Consumer Disclosure, Release of Liability, Waiver of Claims & Arbitration Agreement

PLEASE READ THIS NOTICE CAREFULLY.
This document is part of your agreement for travel-related services with Happily Ever After Travel. Please review your travel documents upon receipt and contact us with any questions. Many travel fares and promotions include restrictions, and changes may result in additional costs. We are always happy to guide you before any changes are made.

Our Role as Your Travel Advisor

Happily Ever After Travel is honored to assist you in planning and coordinating your travel experience. We act solely as a sales agent for the airlines, hotels, cruise lines, tour operators, and other service providers included in your itinerary (“Suppliers”).

While we carefully select and coordinate with trusted Suppliers, please understand that we do not own, operate, or control these Suppliers or the services they provide.

Supplier Responsibility

All reservations are subject to the terms and conditions of the individual Suppliers.

Happily Ever After Travel is not responsible for the acts or omissions of any Supplier, including their failure to provide services, changes to itineraries, delays, cancellations, or service interruptions.

You acknowledge that any services you receive are provided directly by the Supplier, and you agree to be bound by their terms and conditions upon booking.

Limitation of Liability

Happily Ever After Travel assumes no responsibility and shall not be liable for any refund, personal injury, property damage, loss, delay, inconvenience, or irregularity caused by:

  1. The acts, errors, or omissions of any Supplier
  2. Any defect in or failure of transportation, equipment, or services provided by a Supplier
  3. Acts or omissions of any third party not under our control
  4. Changes in pricing after your travel arrangements have been confirmed

By working with Happily Ever After Travel, you agree to release us from any claims arising from the above.

Pricing & Supplier-Imposed Changes

Travel pricing and availability are controlled by Suppliers and may change at any time prior to confirmation.

Airlines, cruise lines, and other Suppliers may impose additional charges, taxes, or fees after booking. By proceeding with your reservation, you acknowledge and accept responsibility for such changes.

All payments made for your travel arrangements are processed directly to the Supplier, not to Happily Ever After Travel.

Travel Documents & Traveler Responsibility

Travel requirements vary by destination and are subject to change at any time.

You are responsible for:

  • Verifying that all traveler names match government-issued identification exactly
  • Obtaining and carrying valid passports, visas, and any required travel documents
  • Meeting all health, vaccination, and entry requirements

Happily Ever After Travel is not responsible for denied boarding, entry, or travel disruptions resulting from incomplete or incorrect documentation.

Travel Protection

We strongly recommend purchasing travel protection to safeguard your investment and provide coverage for unexpected events.

Travel protection options are available through your travel advisor. For your convenience, a link to purchase travel protection independently is also available on our website homepage at any time.

Cancellations, Changes & Supplier Policies

All cancellations and changes are subject to Supplier terms and may result in penalties or fees.

Happily Ever After Travel does not control these policies and is not responsible for cancellation fees, change fees, or the issuance of travel credits or vouchers in place of refunds.

Force Majeure

Happily Ever After Travel shall not be responsible for failure to perform any obligations due to events beyond our control, including but not limited to weather, natural disasters, illness, pandemics, government actions, labor disputes, or travel advisories.

If travel is impacted by such events, refunds, credits, or compensation are subject solely to Supplier policies.

Health, Safety & Travel Conditions

Happily Ever After Travel does not have special knowledge of unsafe conditions, health hazards, or risks at your destination.

You accept full responsibility for researching and understanding travel conditions, including safety, health, and political stability.

Chargebacks & Payment Disputes

By confirming your travel arrangements, you agree to the terms of the Suppliers and acknowledge that cancellation penalties may apply.

In the event of a chargeback initiated to avoid agreed-upon fees, Happily Ever After Travel reserves the right to pursue all remedies available under applicable law, as Suppliers may seek payment directly from the agency.

Dispute Resolution

Happily Ever After Travel is committed to maintaining positive relationships with our clients.

If a concern arises, both parties agree to first attempt resolution through good-faith discussion. If needed, disputes may proceed to mediation and/or arbitration in accordance with applicable guidelines.

Governing Law

This agreement shall be governed by the laws of the State of Texas. Any disputes shall be resolved within the appropriate jurisdiction in Texas.

Acknowledgment

By booking travel with Happily Ever After Travel, you acknowledge that you have read, understand, and agree to these Terms & Conditions.

You also agree to share this information with all members of your travel party.
